近一段时间以来，AMSA在进行PSC检查时，发现部分船公司在船员就业协议（Seafares’EmploymentAgreement,简称SEA）到期后没有及时组织更换船员，而是对现有SEA进行了展期或者重新签署一份SEA，违背了《2006海事劳工公约》的规定。AMSA因此而给出了缺陷。
注意到《2006海事劳工公约》的下列条款：
标准A.2.5.2(b)--海员在有权得到遣返前在船上服务的最长期间—这段时间应少于12个月。（The maximum duration of serviceperiods on board following which a seafarer is entitled to repatriation–such periods to be less than 12 months）。
AMSA对上述“标准A.2.5.2(b)”的解释：Thisdoesn’t necessarily mean they MUSTbe repatriated, but rather they are ENTITLED to repariation。也就是说，《2006海事劳工公约》“标准A.2.5.2(b)”强调了船员应该享受的遣返权利。
同时，我们还注意到《2006海事劳工公约》的下列条款：
标准A.2.4.2—……船员带薪年休假的权利应以每服务两个月最低2.5天计算……（……the annual leave with payentitlement shall be calculated on the basis of a minimum of 2.5 calendar daysper month of employment……）
所以，对于一个日历年，船员可以累积到30天的带薪年休假。
标准A.2.4.3—除非属于主管当局规定的情况，否则禁止达成放弃享受最低带薪年休假的任何协议(Any agreement to forgo theminimum annual leave with pay prescribed in this Standard, except in casesprovided for by the competent authority, shall be prohibited.)
通过国际劳工组织（ILO）的官方网站，我们还可以了解到以下关于船员在船工作时间的进一步解释。即：船员在船的最长工作时间为11个月。

C2.4.c.Does this mean that the maximum period that a seafarer can serve on board a shipis 11 months before taking one month of paid annual leave?
Yes. The concept of paid annualleave implies that it is to be taken annually and therefore the maximum periodfor service on board a ship without leave would be 11 months. This is alsolinked to the requirement in Standard A2.5, paragraph 2(b),regarding theentitlement to repatriation in a period of less than 12 months.
在此，我们提醒各赴澳船东：船员SEA到期前，必须及时组织船员换班。如果船员在船工作时间超过了11个月，AMSA将不予以接受，除非该船员已经获得了船旗国的特别许可。
