A 13-year-old Illinois student has been charged with a Class 4 felony count ofeavesdropping after recording a conversation with his school principal on hiscellphone, according to Illinois Policy, an independent public policy groupthat lobbies for personal freedom.

Paul Boron, a student at Manteno Middle School in Manteno,Ill., reportedly fell afoul of the state’s eavesdropping law when he met withhis principal and assistant principal on Feb. 16.

Boron used his cellphone to record audio from his conversation about detentionswith Principal David Conrad and his assistant principal, Nathan Short. WhenBoron told the men that he was recording their 10-minute discussion, which tookplace in the reception area of the school secretary’s office with the dooropen, Conrad allegedly ended the conversation and warned him that he wasbreaking the law.

Sure enough, Boron was charged with a single count of eavesdropping in April.Kankakee County Assistant State’s Attorney Mark Laws argued that themiddle-schooler “used a cellphone to surreptitiously record a privateconversation between the minor and school officials without consent of allparties.”

Boron, who is visually impaired, is now awaiting his fate — and theprospect of a guilty verdict weighs heavy on his family.

“If I do go to court and get wrongfully convicted, my whole life is ruined,” hetold Illinois Policy, which is pushing to have the eavesdropping law changed.“I think they’re going too far.”

Recording a conversation without the consent of all parties is considered aClass 4 felony as a first offense — the same as crimes like bigamy, childabduction, hate crime, and computer fraud. With a second offense, it becomes aClass 3 felony. While sentencing is determined by the judge, it could involvejail time — or a juvenile detention center — and a fine of up to $25,000.

Boron’s case has raised questions about whether school officials should expectprivacy in their interactions with students, and some have argued that havingthe right to record could protect minors from being subject to abuse.

It’s “Public School” funded by “American Tax”, and the student informedthe principal that he was going to record the conversation. I’ve beenadvocating for cameras in the classroom for 20 years and public schools wantnothing to do with being monitored. I wonder why?

We all know that school officials are so ethical, right? NOT! Allcommunications at schools are public record! This recording is just part ofthat public record. In fact the activities (video and audio) in every classroomshould be recorded for the benefit of the teachers AND the children to keepeveryone honest.

People are being recorded all the time and everywhere without permission.That means we should all start filing charges against all people/companies thatare violating our rights and subject them to felony charges. Just saying.Perhaps, that law needs to be revisited.

First of all, he is 13, and anything he is charged with is more thanlikely a juvenile offence. The fact that the principle and VP pressed chargesis what makes me raise my eyebrow because it makes me wonder what they weresaying to a student that couldn't be recorded. I doubt he will even get amisdemeanor out of this.

Schools, esp the small county ones get away with a lot of things theyshouldn't. I was once brought into the Principal's office and essentiallyinterrogated by the principal and the guidance counselor about where I lived(father had moved us out of the school district because our house wasunlivable). They denied letting me call my dad and I ended up confessing thatmy dad drove me to the house just to pick up the bus in the mornings. Then theycontinued to berate me and demanded we pay owed tuition or that I leave theschool. I was eleven!
