第七条甲乙双方的权利义务
Article 7 Rights and Obligations of Party A and B
（一）甲方的权利义务
(1) Party A's rights and obligations
1．甲方应当负责工程建设项目的协调，为乙方开展监理服务提供必要的条件。
1. Party A shall be responsible for the coordination of the construction project and provide the necessary conditions for Party B to carry out supervision services.
2．甲方应当在双方约定的时间内向乙方提供监理工作所需的工程资料及相关设施。
2. Party A shall, within the time agreed by the parties, provide Party B with the project information and related facilities which required for the supervision work.
3．甲方应当将监理内容及乙方监理人员责任分工以书面形式通知施工方，并需在第三方施工合同中予以明确。
3. Party A shall notify the construction party in writing of the content of supervision and the division of responsibilities of Party B's supervisory personnel, which shall be specified in the construction contract with third party.
4．乙方变更监理工程师须先征得甲方同意。
4. Party B shall obtain Party A's prior consent for any replacement of the Supervising Engineer.
5．监理人员未按约定履行监理职责，甲方有权要求乙方更换。
5. Party A has the right to request Party B to effect replacement of the supervisory personnel who fail to perform the supervisory duties as specified.
（二）乙方的权利义务
(2) Party B's rights and obligations
1．乙方应当按工程规模配备相应监理人员，并将监理人员资料及配备情况以书面形式告知甲方。
1. Party B shall staff the corresponding supervisory personnel pursuant to the scale of the project, and inform Party A in writing of the information and availability of supervisory personnel.
2．乙方未征得甲方同意，不得泄露与本工程合同业务相关的保密资料。
2. Party B shall not, without the consent of Party A, disclose confidential information relating to the business of this works contract.
3．乙方应当按照合同约定的监理服务标准开展监理服务，并应对工程上使用的材料和施工工序的质量标准进行检验，发现不符合标准的，应当及时通知施工方停工整改。
3. Party B shall provide supervision services in accordance with the supervision service standards which specified in the contract, and shall inspect the quality standards of the materials and construction processes which being used in the project, and shall, if the noncompliance of standards is found, promptly notify the construction party to suspend work for rectification.
4．甲方和施工方发生争议时，乙方应当协助甲方处理，并提供监理相关材料。
4. In the event of a dispute between Party A and the construction party, Party B shall assist Party A to deal with it and provide related supervision documents.
5．公共室内装饰工程类的监理项目，乙方应在进入施工现场的 天内向甲方递交适用该工程的监理规划。
5. For the supervision of public interior decoration projects, Party B shall, within days upon entering the construction site, submit to Party A the supervision schedule applicable to the project.
