多港口卸货货物短缺的预防

首先看一下本航次的货物信息:

氯化铵,简称氯铵,是指盐酸的铵盐,多为制碱工业的副产品。含氮24%〜26%,呈白色或略带黄色的方形或八面体小结晶,有粉状和粒状两种剂型,粒状氯化铵不易吸湿,易储存,而粉状氯化铵较多用作生产复肥的基础肥料。属生理酸性肥料,因含氯较多而不宜在酸性土和盐碱土上施用,不宜用作种肥、秧田肥或叶面肥,也不宜在忌氯作物(如烟草、马铃薯、柑橘、茶树等)上施用。氯化铵用于稻田肥效较高而且稳定,因为C1既可抑制稻田硝化作用,又有利于水稻茎秆纤维形成,增加韧性,减少水稻倒伏和病虫侵袭。

据代理提供的货物信息查询DOC for IMSBC CERT 发现此类货物为GROUP C类货物,既没有易流态性,也不属于危险货物。具体如下

本轮完全可以承担本航次的航次任务,船舶可以承载本次货物。

在航次的备仓,发货人的备货过程中,发现东南亚的贸易对于货物的质量把控不是很严,因为上一航次,本轮装载的货物为煤炭;时间紧,基本没有计划有验仓一次性通过的可能性,根据以往的经验,从卸货港到装货仓,在中国领海基线以内,对于货物残渣和洗舱水,参与MARPOL相关规定,存放在SLOP TAnK;并且有大量的货物残渣在货舱中。

基本高处都有煤屑,黑印。货仓舱底未完全干透,整个长江引航过程中,货舱舱盖全部打开,保持旺盛通风。中国商检上船,对货仓状态,没有明确的态度。自始至终在纠结的问题是船上有没有洗过仓,我也自始至终澄清的是我们已经按照租家的指示,认真的备过仓。

租家也将状态反馈船上,投诉船上没有备仓,需要提供货仓状态的照片给他,最后,也是寻求最好状态的照片给租家,最后这件事也不了了之了,所以航次任务比较紧的时候,直接到港就递交NOR,有时候运气也很重要,无需过多的担心,解租如何处理,再次备仓,如何通过的问题。

商检验舱继续,租家也要求上船,最后商检没有验仓报告,发货人租家都不需要商检出示任何货仓适货的报告。

接下来是压载舱的测量,跟初始的水尺计算。发货人,自始至终,就打算以岸数签发提单。我也是本港口刚上船,对于本船的常数以及到底有多少压载水排不出去,没有把握。但是最终,根据观察和计算,最终的常数做到了350 Mt。双方比较满意。船舶开始装货;

本人观点,货物跟航次指令或是C/P描述不一样,就需要在B/L上面备注,或是出示船东能够接受的保函。但是船上可以做自己的LOP。

I, Master of M.V. Great xxxxx notice that during cargo loading operation at Taizhou,China Since 23 Oct 2019, several cargo damage are caked and minor contamination due to Cargo natural characteristic.

The cause of this matter is that stevedores loaded the caked and minor contamination into the hold, resulting the unclear of bill of lading or receiver reject all cargo at next port. the shipper should therefore take all responsibilities for all the loss, claims. etc.

In view of the fact above, I, master of “Greatxxxxxx” hereby note my protest against all losses, damages, etc. reserving my right to make a claim on the parties concerned and to extend the same at time and place convenient.

无任何方回复,货物状态的邮件,租家指示船长可以将货物状态的描述加入到大副收据当中。

这件事情刚告一段落,发货人指挥工头转告船上货量要减少,大约减少1000mt 左右,之后要求租家发报到船上,也没有明确的指令。在货物装到34761吨的时候,发货人称没有货了,完货准备开航。

水尺检验,跟岸数比较相差40 吨,发货人拒绝船舶开航,并且坚持要船上货量做到与岸上一致,或是有所妥协,并且大副收据,也仅签一份,正本大副收据不留船。

最后船上妥协,同意将水尺报告的数量再增加20吨,船舶开航。但是船舶还没有达到宣载量。船上递交 Dead Freight Letter

In accordance with the terms and conditions of the Charter Party applicable to this voyage and the sailing instructions, the vessel ordered CHONGQING AGRICULTURAL CHAIN CORPATION LIMITED to provide on board 35000.0 MT metric tons of FERTILIZER IN BULK at TAIZHOU,CHINA for carriage to

TAIZHOU – LAHAD DATU: 13500MT FERTILIZER IN BULK

TAIZHOU – BINTULU: 13500MT FERTILIZER IN BULK

TAIZHOU – DUMAI: 8000MT FERTILIZER IN BULK

and had provided cargo space on board sufficient to load the quantity as so ordered accordingly.

Upon the completion of loading at this port on 1400LT 30th OCT 2019, the total cargo loaded on board was found to be 34781.00 metric tons as per quantity shown on the Mate’s Receipt / Bills of lading, which is definitely short of the quantity as so ordered.

Therefore, I, the Master of the M.V.GREAT xxxxxxx hold all of you fully responsible and liable for loss of freight or other result whatsoever due to and/or in relation to the alleged shortage of 219.00 metric tons of FERTILIZER IN BULK as the above-mentioned.

本航次总共7个收货人,每个收货人都安排水尺检验,每个港平均需要做三次水尺报告。按照经验水尺检验正常1个TPC的误差,这样的三个卸货港多次误差累计的话,根本不可能按照提单数,完成所有的交货,并且卸货量跟水尺检验根本不可能完全的一致。所以,本航次的三个卸货港,计划每个港LOP,假如在航次的前二个港做出有200MT的差值,第三个港基本就能无索赔,并且,作为托运人也尽到了恪尽职守的义务

对于第一个收货人,出示了第一个LOP,货量跟卸货量差值不大。

但是第二票货的检验员换为另一家公司,第二个收货人的货量初次水尺报告为第一收货人末次水尺。

the total quantity of cargo discharged was found to be as follows:

As per Ships draft survey: 4050.142 MT (for 2nd receiver:figure come from 3 rd receiver initial and 1st receiver final report) 

As per LOI figures (B/L) : 4000.0 MT for 2nd receiver

The difference between LOI figure(B/L) is: 50.142 MT

All cargo as per Bill of Lading quantities has been over discharged.

并且,我也复印第三收货人的检验员ID

第二收货人,在发现水尺报告货量多于实际卸货量后,拒绝出示水尺报告,并且不让我再碰所有的他的文件,除了原先照下的照片跟初次水尺的照片。

有了第一个卸货港的经验后,觉得收货人在岸数上可能做手脚,并且所有的转港货可能被本港的收货人多卸,所以第二个港口我是这样准备的报告

All ship’s survey report/calculation are truly and independent observation draft with receivers’ surveyor.The cargo as per Bill of Lading quantities has been over discharged at Bintulu is 94.42MT.

同样检验员拒绝出示他们的水尺报告,并且反复的说问题出现在哪里,因为在每次的水尺读数中他们都故意抬水尺,以有利于收货人。并且没有水尺报告的前提下,检验员代表收货人给船上LOP,并且声称禁止船舶出港,肯定也不能给他签署任何LOP,并且根据国际贸易的一般惯例,也不可能接受岸数,如下

As independent superintendent nominated to conduct the draft survey of the abovementioned cargo, we have to draw your attention to the following factors which could have significantly affected the accuracy of Draft Survey reading / calculations, thus it was disputed an error.

Vessel was noted to be hogging by 2.60 CM (TPC 50.30 M/TONS) during initial draft survey on 20th November, 2019 and was hogging by 4.95 CM (TPC 48.80 M/TONS) during final draft survey on 24th November, 2019.

On behalf of WHOM IT MAY CONCERN, we are compelled to file reserves / protest and hold you fully responsible on the foregoing and any detrimental / material consequences resulting thereof.

并且,倘若货物没有短缺,检验员也不能不出示自己的水尺报告。并且收货人检验员同意在我做的水尺报告中签字,备注 reciver only ,qty in disput.

最后一个卸货港,一个收货人 ,水尺基本不再看,并且也保证了足量交货。

对于多港口卸货,没有隔票没有分仓的货物,并且每个收货人都做水尺,建议还是要多加小心,即使每个港都做到很准,但是检验员代表的是收货人,本身就有对立,况且还没有船东的P&I,一定要留好自己证据,切实保护好自己。
